SynergEyes® is committed to providing the highest quality of customer service and in efforts to respect the privacy of our current and potential customers, we want to explain more about how we are working to respect your information privacy rights, especially in light of the new CCPA law, enacted as of January 1, 2020.

“Do Not Sell” Requests

SynergEyes provides consumers the ability to send requests to not have their information “sold” by us by sending a request to webmarketing@synergeyes.com including the consumer’s full name, email address, and if known, IP address, to ensure the ability of SynergEyes to most accurately comply with a request.

What does it mean to have your information “sold”?

The CCPA broadens the definition of “sale” and “personal information” beyond how you might commonly interpret those terms.

Under the CCPA, “personal information” includes information that is not necessarily directly tied to an individual’s identity but may be associated with an individual’s device. This includes identifiers such as IP addresses, web cookies, web beacons, and mobile AdIDs. In many cases, this type of information is not associated with an individual explicitly, but because they are unique identifiers, it could be possible to associate that information with an individual. Similarly, the term “sell” is defined to include not just selling in exchange for money, but also sharing or transferring personal information (including information that does not directly identify an individual as described above) in exchange for anything of value, which is not limited to the exchange of money. Certain things are not considered “sales,’ including when 1) personal information is shared with a service provider that is contractually prohibited from using the personal information for any purpose beyond the service specifically requested (“service provider exception”), or 2) when the consumer has directed a company to disclose the personal information (“consumer directed exception”).

Does SynergEyes “Sell” My Personal Information?

SynergEyes does not sell information that directly identifies you, including your name, address or phone number. We also never share that information except with service providers who can use the information solely to provide a service on our behalf, when a consumer directs us to share the information, or in the limited additional circumstances outlined in our Privacy Policy including for fraud prevention or where we are legally required to share the information.

The CCPA’s broad definitions of “sale” and “personal information” may deem the common flow of information for purposes of digital analytics and advertising as a sale. SynergEyes uses online analytics tools to measure how users engage with our website. The information gathered by these tools allows SynergEyes to target online advertising, and informs how we arrange information on our website. In order to obtain information, these third-party analytics tools may place identifiers including tags, cookies and beacons. Where we can reasonably ensure via contract that the third-parties described here can and will use a device identifier solely to provide the specific services requested, and will not use or share the data for other purposes, we will not consider that sharing as a “sale.” However, in cases where we cannot fully ensure that a third-party will not share your information, we will consider that access a “sale” and will take all reasonable actions to ensure that your information is not shared.

What Happens When I Request Not To Have My Information “Sold”?

When a consumer submits a “Do Not Sell” or “Right to Be Forgotten” request to webmarketing@synergeyes.com, we will flag that user’s account in our user database, as well as take all reasonable efforts to exclude their IP from any remarketing efforts within our analytics platforms. This preference will remain in place in perpetuity until, or in the case, that a consumer requests to change the status of access to their information.
